In the document ‘Decisions in the Constitutional Court', all documentation gathered, generated or conserved by the Court in the exercise of its competences and activities, whether jurisdictional or administrative, and regardless of whether it is in paper or electronic format, is part of the Archive of the Constitutional Court. It constitutes its documentary heritage, subject to Law 16/1985. Official documents are also public assets subject to a specific legal regime and, therefore, they are unattachable, inalienable and imprescriptible, although they can be eliminated by means of a previously established and lawful decision procedure that also contemplates the replacement of originals in different formats.
The Document Evaluation Committee of the Constitutional Court is a collegiate body that evaluates original documents from the perspective of their legal validity and their testimonial and historical value, in order to determine the period of their retention and their final destination, after that validity has expired and depending on whether or not that second value exists. Created by Agreement of 24 April 2024, of the Plenary of the Constitutional Court, it also foresees the procedure to be followed for the evaluation and elimination of its documents and for the establishment of the accessibility of the documentary series in general, in cases where it is possible to determine it.
